Lexington car accident lawyer Frank M. Jenkins III said today that all Kentuckians should be concerned by preliminary data that indicate the first year-to-year increase in motor vehicle accident deaths in the U.S. since 2005.

"The National Safety Council says there was a 5 percent increase in fatal car accidents nationwide in 2012 and that Kentucky posted a 3 percent increase in motor vehicle fatalities as well," said Jenkins, founder of the Frank Jenkins Law Office. "The increase in car accident deaths is not only the first in seven years for the nation, but it's also a reversal for Kentucky, which had fewer in 2011 compared to 2010."

Jenkins was referring to a National Safety Council (NSC) report that says approximately 36,200 motor vehicle fatalities occurred in 2012. This marks a 5 percent increase from 2011, the first year-to-year increase since 2004 to 2005, the report says.

There were 743 motor vehicle deaths in Kentucky in 2012, a 3 percent increase from the 718 fatal car accidents in the state in 2011, the NSC says. There were 759 deaths in Kentucky car wrecks in 2010.

The NSC also estimated there were 3.9 million personal injuries in car accidents that required medical attention in 2012, a 5 percent increase from 2011.

Texas had the most car accident fatalities in 2012, with 3,339; followed by California, with 2,994; and Florida with 2,442 traffic deaths. Alaska had the fewest, with 59 car accident fatalities, an 18 percent drop from 72 recorded in 2011, according to the NSC data.

Kentucky's neighboring state of Ohio had 1,113 fatalities in car wrecks in 2012, a 9 percent increase from 2011, and West Virginia had 335, a 1 percent decrease year-to-year, the NSC said. Indiana had 778 fatalities, a 4 percent jump from 2011.

"What's truly disheartening about this is that we know that car accidents are chiefly caused by such reckless behavior as drunk driving, distracted driving, speeding and other types of aggressive driving," Jenkins said.

"Most car accidents are entirely avoidable," the veteran Kentucky attorney said.

National Safety Council President and CEO Janet Froetscher said in a news release that the upswing in traffic fatalities represents "new challenges, especially as it relates to teen and distracted driving, that need to be addressed on a national scale."

Jenkins said studies show that distracted driving, in particular texting while driving and other use of cell phones behind the wheel, as well as speeding and aggressive driving (improper passing, frequent lane changes, following too closely, etc.), are more prevalent among younger drivers.

According to the NSC report, traffic fatalities nationwide increased by 5 percent in 2012, marking the first increase in seven years. Approximately 36,200 fatalities occurred on U.S. roads, the NSC says.

However, Rhode Island's fatality total went in the opposite direction. The NSC report shows that the state's motor vehicle accident deaths dropped by 6 percent in 2012. This comes on the heels of a 4 percent decrease in 2011.

With new reports of an increase in pedestrian traffic accident deaths in New Jersey last year, car accident lawyer Joseph A. Ginarte today called on both drivers and authorities to take measures to reverse the trend.

He was referring to a preliminary report from the New Jersey State Police that indicated 165 pedestrians died in car accidents in 2012, up from 143 in 2011, despite the overall number of fatal crashes in the state going down by 5.6 percent. In 2012, pedestrians accounted for 28 percent of fatal crash victims in New Jersey, up from 23 percent in 2011.

In the country as a whole, a total of 4,432 pedestrians were killed by cars in 2011, accounting for 14 percent of all traffic fatalities, according to the National Highway Traffic Safety Administration (NHTSA). A pedestrian is killed every two hours and injured every eight minutes in a car crash somewhere in the United States.

"These statistics are very alarming and totally unacceptable," Ginarte said. "Usually, pedestrians are just going about their daily business, like walking, jogging, crossing a street or carrying shopping bags, when these accidents occur. We must find a way to keep pedestrians safe through education, awareness and simply paying better attention to our surroundings. We also need to find out why the number of pedestrian car accident victims in New Jersey is going up and is so much higher than the national average."

Accidents can also result in very serious injuries for pedestrians. According to NHTSA, in 2011, 70,000 pedestrians suffered injuries such as broken bones, traumatic brain injuries, back and spinal cord injuries, paralysis and internal injuries.

"The David-versus-Goliath nature of pedestrian accidents makes them even more dangerous and the injuries even more severe," Ginarte said. "Pedestrians are no match for large vehicles driving down the highway."

Recent data on overall car accidents do provide some good news. In 2012, there were 556 fatal crashes in New Jersey, down from 586 in 2011, according to the New Jersey State Police. The overall number of fatalities in the state also decreased, with 592 in 2012 and 627 in 2011.

"At a time when the overall number of car accident fatalities is going down, the number of pedestrian deaths should not be increasing," Ginarte said. "We support efforts by government, police and the public to continue the overall downward trend in traffic fatalities. But we also need to find out why pedestrian accident fatalities are not following this trend in New Jersey and take steps to reduce the number of these accidents."

The court documents go on to allege that (1) the defendant acted negligently in failing to stop in time to avoid hitting the defendant from behind; (2) the defendant's negligence is what caused the plaintiff's injuries and his financial and intangible losses and (3) the plaintiff has suffered and will continue to suffer losses as a result of the collision. The lawsuit was filed in an effort to recover damages that will compensate the plaintiff for these losses. The case remains pending in the Nevada court system.
