Lexington Car Accident Lawyer At Frank Jenkins Law Office Dismayed By NSC ... - PR Web (press release)

Lexington, Ky. (PRWEB) March 08, 2013

Lexington car accident lawyer Frank M. Jenkins III said today that all Kentuckians should be concerned by preliminary data that indicate the first year-to-year increase in motor vehicle accident deaths in the U.S. since 2005.

"The National Safety Council says there was a 5 percent increase in fatal car accidents nationwide in 2012 and that Kentucky posted a 3 percent increase in motor vehicle fatalities as well," said Jenkins, founder of the Frank Jenkins Law Office. "The increase in car accident deaths is not only the first in seven years for the nation, but it's also a reversal for Kentucky, which had fewer in 2011 compared to 2010."

Jenkins was referring to a National Safety Council (NSC) report that says approximately 36,200 motor vehicle fatalities occurred in 2012. This marks a 5 percent increase from 2011, the first year-to-year increase since 2004 to 2005, the report says.

There were 743 motor vehicle deaths in Kentucky in 2012, a 3 percent increase from the 718 fatal car accidents in the state in 2011, the NSC says. There were 759 deaths in Kentucky car wrecks in 2010.

The NSC also estimated there were 3.9 million personal injuries in car accidents that required medical attention in 2012, a 5 percent increase from 2011.

Texas had the most car accident fatalities in 2012, with 3,339; followed by California, with 2,994; and Florida with 2,442 traffic deaths. Alaska had the fewest, with 59 car accident fatalities, an 18 percent drop from 72 recorded in 2011, according to the NSC data.

Kentucky's neighboring state of Ohio had 1,113 fatalities in car wrecks in 2012, a 9 percent increase from 2011, and West Virginia had 335, a 1 percent decrease year-to-year, the NSC said. Indiana had 778 fatalities, a 4 percent jump from 2011.

"What's truly disheartening about this is that we know that car accidents are chiefly caused by such reckless behavior as drunk driving, distracted driving, speeding and other types of aggressive driving," Jenkins said.

"Most car accidents are entirely avoidable," the veteran Kentucky attorney said.

National Safety Council President and CEO Janet Froetscher said in a news release that the upswing in traffic fatalities represents "new challenges, especially as it relates to teen and distracted driving, that need to be addressed on a national scale."

Jenkins said studies show that distracted driving, in particular texting while driving and other use of cell phones behind the wheel, as well as speeding and aggressive driving (improper passing, frequent lane changes, following too closely, etc.), are more prevalent among younger drivers.

The Frank Jenkins Law Office investigates car accidents in the development of personal injury and wrongful death lawsuits on behalf of people hurt by reckless and negligent drivers in Kentucky. Jenkins said anyone who has been injured or lost a loved one in a traffic accident of any kind should contact an experienced car accident attorney to review the circumstances of their case.

"The NSC study also points out that the cost of motor vehicle deaths, injuries and property damage in 2012 was about $276 billion," Jenkins said. "People who have been unjustly hurt in a car wreck because of someone else's negligence deserve to be compensated for their losses. The Frank Jenkins Law Office will continue to stand as their advocate in Kentucky."

Providence Car Accident Lawyer Mark W. Gemma Says State Can't Rest on 6 ... - PR Web (press release)

Providence, R.I. (PRWEB) March 07, 2013

Providence car accident lawyer Mark W. Gemma said today that Rhode Island residents can take pride in a new National Safety Council report showing a continued reduction in the state's traffic accident deaths.

According to the NSC report, traffic fatalities nationwide increased by 5 percent in 2012, marking the first increase in seven years. Approximately 36,200 fatalities occurred on U.S. roads, the NSC says.

However, Rhode Island's fatality total went in the opposite direction. The NSC report shows that the state's motor vehicle accident deaths dropped by 6 percent in 2012. This comes on the heels of a 4 percent decrease in 2011.

"The fact that Rhode Island is experiencing fewer fatal car accidents is good news and very encouraging," Gemma said. "We can take pride in knowing that a combination of legislation, law enforcement efforts and public awareness campaigns are getting results.

"Of course, that doesn't mean we can rest on our accomplishments," he added. "We need to continue to make progress in eliminating unnecessary accidents, injuries and deaths."

Gemma is a principal attorney at the Rhode Island personal injury law firm of Gemma Law Associates, Inc., which is dedicated to promoting traffic safety and protecting the rights of car and other motor vehicle accident victims.

The attorney pointed out that, when compared to other similar states, Rhode Island had considerably lower car accident fatality numbers.

The NSC reported 64 fatal car wrecks in Rhode Island in 2012 and 67 in 2011. However, neighboring Connecticut (the third-smallest U.S. state by land mass) had 262 car crash fatalities in 2012, or 19 percent more than the 220 in 2011. Delaware, which is second to Rhode Island for the smallest land mass among U.S. states, had 116 car accident fatalities in 2012, a 13 percent increase from the 103 deaths in car wrecks in 2011.

"We're fortunate to have fewer fatal car accidents in Rhode Island, but even one fatality is one too many for the family that suffers that loss," Gemma said.

"This is particularly true when you consider that most fatal car crashes are caused by preventable driver error and recklessness, like distracted driving, speeding, drunk driving and similar dangerous behavior," he said.

When reckless driving contributes to a fatal car accident or a crash that causes personal injury, the at-fault driver should be held accountable, Gemma added.

"Gemma Law will continue to stand up for the rights of car accident victims," he said, "and by doing so, we are helping to make Rhode Island a safer place."

Injury Lawyer At Ginarte O'Dwyer Gonzalez Gallardo & Winograd Urges Action ... - PR Web (press release)

Newark, NJ (PRWEB) March 07, 2013

With new reports of an increase in pedestrian traffic accident deaths in New Jersey last year, car accident lawyer Joseph A. Ginarte today called on both drivers and authorities to take measures to reverse the trend.

"Drivers, pedestrians and authorities must all work together to prevent accidents that kill and injure many," said Ginarte, founder of Ginarte O'Dwyer Gonzalez Gallardo & Winograd, a law firm that focuses on car accidents. "Everyone, no matter what mode of transportation they are using, must follow the law, and police must enforce those laws."

He was referring to a preliminary report from the New Jersey State Police that indicated 165 pedestrians died in car accidents in 2012, up from 143 in 2011, despite the overall number of fatal crashes in the state going down by 5.6 percent. In 2012, pedestrians accounted for 28 percent of fatal crash victims in New Jersey, up from 23 percent in 2011.

In the country as a whole, a total of 4,432 pedestrians were killed by cars in 2011, accounting for 14 percent of all traffic fatalities, according to the National Highway Traffic Safety Administration (NHTSA). A pedestrian is killed every two hours and injured every eight minutes in a car crash somewhere in the United States.

"These statistics are very alarming and totally unacceptable," Ginarte said. "Usually, pedestrians are just going about their daily business, like walking, jogging, crossing a street or carrying shopping bags, when these accidents occur. We must find a way to keep pedestrians safe through education, awareness and simply paying better attention to our surroundings. We also need to find out why the number of pedestrian car accident victims in New Jersey is going up and is so much higher than the national average."

Accidents can also result in very serious injuries for pedestrians. According to NHTSA, in 2011, 70,000 pedestrians suffered injuries such as broken bones, traumatic brain injuries, back and spinal cord injuries, paralysis and internal injuries.

"The David-versus-Goliath nature of pedestrian accidents makes them even more dangerous and the injuries even more severe," Ginarte said. "Pedestrians are no match for large vehicles driving down the highway."

Recent data on overall car accidents do provide some good news. In 2012, there were 556 fatal crashes in New Jersey, down from 586 in 2011, according to the New Jersey State Police. The overall number of fatalities in the state also decreased, with 592 in 2012 and 627 in 2011.

"At a time when the overall number of car accident fatalities is going down, the number of pedestrian deaths should not be increasing," Ginarte said. "We support efforts by government, police and the public to continue the overall downward trend in traffic fatalities. But we also need to find out why pedestrian accident fatalities are not following this trend in New Jersey and take steps to reduce the number of these accidents."

Ginarte urged anyone who has been injured or lost a loved one in a New Jersey car crash to get help from a qualified lawyer like those at Ginarte O'Dwyer Gonzalez Gallardo & Winograd.
"We have the experience to go up against negligent drivers and their insurance companies and get you the compensation you deserve," he said.

Denver Lawyer Has A Warning For All Drivers: Full Coverage Car Insurance Is A ... - MarketWatch (press release)

DENVER, March 6, 2013 /PRNewswire via COMTEX/ -- It seems every other commercial is for insurance these days. These billion-dollar companies promise big savings and the best "full coverage" car insurance.

Denver lawyer & auto injury expert Dr. Joseph Ramos says, "Full coverage car insurance is a myth. What really matters is the specific amount of coverage you have. You'd be shocked by the amount of people we help who don't find out until it's too late, including very wealthy clients."

Most insurance companies won't sell you what you need; you have to ask for it. Below is what the car accident lawyers from the Ramos Injury Firm suggest drivers have in their auto insurance policy:

Bodily Injury Insurance coverage protects you if you cause an auto accident. States like Colorado only require drivers to carry $25,000 in coverage. Minimum coverage is often inadequate which can expose your personal assets. The Ramos Law Firm Injury Experts recommend at least $100,000 in Bodily Injury coverage.

Uninsured & Underinsured Protection (UM/UIM) coverage is essential and most drivers don't know what it is or if they even have it. This coverage protects you if you're hurt in an accident by a driver who does not have enough (or any) insurance. The more coverage you have, the better the protection. The Ramos Injury Law Firm recommends a minimum of $100,000 in UM/UIM insurance.

Denver Lawyer Brian Calandra of The Ramos Injury Firm says, "Having the right amount of car insurance coverage could be the difference between stability and bankruptcy."

Check your car insurance today and make sure you have enough coverage. An extra $5 to $15 a month could fill the gaps in your policy.

The Ramos Injury Firm is a personal injury law firm in Colorado that offers something no other Denver law firm can: a trained emergency medicine physician who is also a lawyer. Joseph Ramos, MD, JD, is an ER doctor and attorney with years of experience helping the injured. Please visit http://www.RamosInjuryFirm.com for more information The Ramos Injury Firm.

Buckfire & Buckfire Auto Accident Attorneys Discuss New Statistics on Increase ... - Virtual-Strategy Magazine (press release)

The distracted driving car accident lawyers at Buckfire & Buckfire, P.C. discuss recent study on increase of teen deaths and a victims rights after injuries in a Michigan auto accident.

Detroit, MI (PRWEB) March 05, 2013

Car accidents remain the number one cause of death among teenage drivers. In fact, according to a recent study released by the Governors Highway Safety Association, deaths of 16 and 17 year olds in traffic accidents in the first six months of 2012 were up 19 percent over the same time period in the previous year. Reports showed that there were 107 teen drivers killed in that sixth month period in 2012, compared to 86 teen deaths in 2011 in that same time period.

State official believe that this increase in car accidents among teens is due to the advancement in technology, which allows a greater opportunity for teens to drive while being distracted. In another study to back that reasoning, done by the Wireless Association (CTIA), in the month of June 2011, more than 196 billion text messages were sent or received in the United States, up nearly 50% from June 2009.

Driving while texting is a form of distracted driving, and is extremely dangerous, yet very common, particularly among teenagers. In Michigan alone, according to MLive.com, 61% of teens admitted to texting while driving. The use of a cell phone while driving proved to be dangerous and very apparent in Michigan, as MLive also released reports that since 2001, 800 car accidents per year involved cell phone use. In addition, in 2010, in the State of Michigan, from January to June, there were a total of 397 car accidents that involved cell phone use.

Other studies have also shown that dangerous crashes are not just limited to texting while driving car accidents. Distracted driving can also consist of eating, talking to passengers, applying makeup, reading (including maps), using a navigational system, adjusting the radio, attending to children in the back seat, and more.

Michigan law does prohibit to text while driving. The Michigan anti-texting law (sec. 257.602.b) states that driver shall not "read, manually type, or send a text message on a wireless 2-way communication device that is located in the persons' hand or in the person's lap, including a wireless telephone used in cellular telephone service or personal communication service, while operating a motor vehicle that is moving on a highway or street."

Persons killed or injured in a Michigan auto accident due to a negligent driver texting while driving, or any other form of distracted driving do have the legal to pursue claims for personal injuries against the negligent driver as well as a claim for no-fault insurance benefits. Victims, including teens injured in Michigan auto accident, even if considered at fault, may also have means to file a claim for no-fault insurance benefits.

If an individual is killed in a distracted driving auto accident, the family of the deceased may have the right to file a Michigan wrongful death lawsuit and/or file a claim for survivor loss benefits. Survivor loss benefits may be able to be claimed even if the driver killed was at fault for the collision.

"When an individual is injured in an accident, it is important that that person hires a Michigan car accident attorney who will pay detailed attention to their case. By limiting the number of cases our personal injury law firm accepts, our top rated auto accident attorneys can devote our full time and energy to each client," says Partner and Trial Attorney Lawrence J. Buckfire.

El Paso Auto Accident Lawyer Michael Gopin Warns Pedestrians of Distracted ... - Virtual-Strategy Magazine (press release)

El Paso personal injury attorney Michael J. Gopin comments on recent reports of a pedestrian fatality due to a car collision in downtown El Paso.

El Paso, TX (PRWEB) March 03, 2013

El Paso resident and former newsman John Garmon was hit by a car while crossing a street in downtown El Paso, in what was the second El Paso traffic fatality already this year and the first pedestrian death, according to the El Paso Times. Fatal accidents involving pedestrians have been increasing over recent years, said El Paso personal injury lawyer Michael Gopin.

The El Paso Times story on Jan. 27 describes Garmon as having been run over in a crosswalk by a driver who did not see him and who was unable to slow down in order to avoid hitting the crash victim. The report says that the driver of the car that hit the pedestrian remained at the scene of the accident until police arrived, and that the fatal El Paso collision took place at approximately 8pm on Jan. 26.

While the cause of the Jan. 26 accident is still under investigation, attorney Gopin, of the Law Offices of Michael J. Gopin, P.C., cautions all El Paso pedestrians to be especially careful of drunk drivers in downtown El Paso on weekends. According to the Texas Department of Transportation's report, "Texas Motor Vehicle Traffic Crash Highlights: Calendar Year 2011," more Texas DUI accidents took place on Saturdays that year than on any other day of the week. El Paso car accident attorney Gopin also noted that the report shows that Texas pedestrian accident fatalities increased by 17% in 2011 from the year previous and that 34.5% of all motor vehicle crashes in Texas that year involved a driver who was under the influence of alcohol at the time of the accident.

Though the cause of the collision has not yet been established, El Paso personal injury lawyer Michael Gopin said that driver distraction of some kind could also be a factor, such as texting behind the wheel, making a cell phone call while driving, using a GPS unit or an in-dash tablet.

"Distracted drivers who are texting or making cell phone calls while driving can be dangerous to everyone on the road," Gopin said. "Distracted driving has been linked to all kinds of common accidents, including rear-end collisions and accidents involving pedestrian injuries and fatalities. Drivers who send and read text messages at the wheel may be more distracted than drunk drivers. In some accident fatality and injury lawsuits, law enforcement and the Texas personal injury attorney handling the case for the plaintiff can examine the driver's cell phone or smart phone records to determine if he or she was using it at the time of the accident."

The El Paso Times article quoted El Paso Mayor John Cook as saying that El Paso has a high rate of pedestrian-motor vehicle collisions. Texas accident lawyer Gopin encourages anyone walking in El Paso to always look for oncoming cars before crossing a street—even on a green light.

Knoxville Personal Injury Lawyer G. Turner Howard Discusses New Technology ... - Virtual-Strategy Magazine (press release)

Knoxville car accident attorney G. Turner Howard weighs in on new mobile application available to drivers through the Tennessee Department of Transportation.

Knoxville, Tennessee (PRWEB) March 02, 2013

Knoxville personal injury lawyer G. Turner Howard III today said a new mobile phone application could lead to fewer accidents and injuries, as the "app" allows drivers to access the latest information on Tennessee highway traffic, accidents, road conditions, construction zones, roadside cameras and dynamic message sign displays.

According to a January 25 announcement by the Tennessee DOT, more than 35,000 users have downloaded the SmartWay Mobile App since it was launched at the end of December. The transportation department says that the app was created to assist drivers in navigating Tennessee highways more safely and is available at no charge for download in the Play Store for Android and Apple App Store.

Knoxville car accident attorney Howard sees the TDOT SmartWay App as a useful tool for drivers who wish to avoid traffic back-ups due to car crashes, semi-truck collisions, road construction, detours and other traffic delays. "The new traffic app can be useful in the same way radio traffic reports help Knoxville, Tennessee drivers to steer clear of highway accidents on Interstate 275, I-75 and I-40, making their morning or afternoon commuting safer," Howard said. "The app can inform drivers of dangerous accident scenes so they can avoid those areas. Very often, all the rubber-necking by drivers passing by car crashes can result in rear-end collisions. If this app helps reduce auto accidents on top of making rush hour commutes easier, that's certainly a good thing."

The TDOT announcement makes a point of reminding drivers to use the TDOT SmartWay App carefully and responsibly. It encourages drivers to check traffic conditions before heading toward their destination, using its motto "Know before you go!" and urges motorists to never tweet, use any mobile device or text behind the wheel.

Howard emphasizes this latter point. "It is vital for drivers to understand that the TDOT's SmartWay app should only be used by drivers when the car engine is not running or by automobile passengers helping to navigate the best route during a trip," Howard said. "Cell phone use behind the wheel and texting drivers already cause enough distracted driving accidents on Knoxville roads and highways, and this new traffic app is not intended to distract drivers in any way."

Atlanta Accident Injury Lawyers Remind You to Be Careful on Your Motorcycle ... - EIN News (press release)

The accident lawyers in Atlanta would like to remind motorcyclists to drive safely this winter. These vehicles are not meant for driving on slick roads, and they are much more difficult to control than cars or trucks when sliding does occur.

NORCROSS, GA, February 27, 2013 /24-7PressRelease/ -- The accidents lawyers in Atlanta, McAleer Law, want to remind motorcycle riders to be extra careful this winter. Although Atlanta is rarely subjected to harsh weather during this time of year, storms have happened in the past. While safe driving techniques are something that all drivers should practice, motorcyclists need to take extra precautions when on the road. The main reason being that two wheels are harder to control than four when snow and ice are involved; cars and trucks have the advantage of weight distribution. If a motorcycle starts to slide, there is a very slim chance that the rider will be able to correct the issue, even if they are skilled.

Atlanta accident injury lawyer notes that other drivers are often to blame

With gas prices on the rise, this mode of transportation has become increasingly popular. Motorcycles are certainly more fuel-efficient, but these cost-savings can be quickly be outweighed by medical bills resulting from winter-weather accidents. This is what the accident lawyers in Atlanta want riders to be aware of. According to Charles McAleer, Founder of McAleer Law, "It is important to remember that most motorcycle accidents are not caused by reckless driving on the part of the cyclist. Rather, fellow motorist failure to notice them on the road or who fail to yield to riders is what often causes these types of accidents. No matter how much protective gear a motorcyclist is equipped with, the risk of serious injury will always be higher than drivers in passenger vehicles." The Atlanta car accident attorney offers extensive services to riders injured in motorcycle accidents. If you have found yourself subject to an injury that you believe is the fault of another driver, be sure to contact the experts at McAleer Law today. Here are some helpful tips for driving your motorcycle safely this winter.

How to Prevent an Atlanta Car Accident This Winter

- Wear the proper gear; failure to dress appropriately can lead to rider fatigue. When you become tiresome on the road, your reaction time slows and the risk of getting in an accident is increased. Stay warm and stay safe.

- Drive only when necessary; if you have to take the motorcycle, be sure to slow down and allow plenty of room between yourself and other motorists.

- Wear reflective clothing to help other drivers and pedestrians identify you on the road.

- Perform a vehicle inspection before every trip; check your lights, signals and tires before venturing out.

- Remember that windy conditions affect motorcycles more; plan your trips accordingly.

Yakima Car Accident Lawyer at Mariano Morales Law Encourages Continued ... - Seattle Post Intelligencer

Mariano Morales, a Washington State personal injury lawyer, says government agencies should continue their efforts to prevent distracted driving crashes even after the departure of Ray LaHood, the Transportation Secretary who brought attention to the issue.

Yakima, Wash. (PRWEB) February 26, 2013

Federal efforts to raise awareness about distracted driving are an important part of preventing serious car accidents, and Yakima personal injury lawyer Mariano Morales today called on the government to continue its efforts to combat distracted driving even after the current Department of Transportation head steps down.

Outgoing U.S. Transportation Secretary Ray LaHood made preventing distracted driving a cornerstone of his years in office. Since 2009, the U.S. Department of Transportation has held two national distracted driving summits, banned texting and cell phone use for commercial drivers, encouraged states to adopt tough laws and launched several campaigns to raise public awareness about the issue.

"Cars are full of distractions, from cell phones to GPS units and even passengers. Anything that draws attention to this dangerous problem and prevents more people from driving while distracted is good for the people of Washington and the United States," said Morales, founder of Mariano Morales Law, a Yakima-based personal injury law firm.

According to a recent news article, the National Highway Traffic Safety Administration (NHTSA) says that it will continue LaHood's efforts to combat the dangerous practice of distracted driving even after the secretary leaves.

"Secretary LaHood made a real difference in highlighting the dangers of distracted driving through things like his speeches, blog and the website Distraction.gov," Morales said. "We are encouraged that this important work will continue even after LaHood steps down from his post because there is still so much work to be done."

NHTSA recently reported it is close to finalizing voluntary in-vehicle guidelines to help carmakers avert distracted driving. The proposals include limits to manual inputs for in-car devices, limiting to two seconds the time needed to look away from the road to operate devices and limiting unnecessary visual information in the driver's field of view.

"Voluntary guidelines are a good step, but it's just a first step," Morales said. "We urge NHTSA and other government agencies to press on in their efforts to prevent crashes caused by distracted drivers and save lives."

According to NHTSA, 3,331 people were killed in distracted driving crashes in 2011 and 387,000 people were injured in car accidents involving a distracted driver.

Cell phone use, and texting in particular, is especially dangerous because it takes a person's eyes off the road and hands off the wheel. A federal study shows that texting increases the risk of having a car accident by 23 times.

"The dangers of distracted driving are clear and underscore the importance of continued campaigns against this dangerous practice," Morales said. "Just like education on drinking and driving raised awareness of that issue, we must work to raise the profile of distracted driving and prevent the serious car crashes that can result from it."

In Washington State, it is illegal for drivers to talk or text on a handheld cell phone. New drivers can't use handheld or hands-free devices. But a law cannot actually stop everyone from using cell phones while driving, and other distractions abound behind the wheel.

Morales encouraged anyone who has been a victim of a distracted driving accident to seek legal help from a qualified car accident lawyer such as those at Mariano Morales Law. "Our firm has the knowledge and experience to fully investigate distracted driving cases and get victims the compensation they deserve," he said.
